1. INTRODUCTORY PROVISIONS
1.1. These Terms and Conditions of YAGE Organics s.r.o., Company ID No. 05353921, with its registered office at Šmeralova 5, Prague 7, 170 00 (hereinafter referred to as the “Seller”), regulate, in accordance with Section 1751 of Act No. 89/2012 Coll., the Civil Code, the mutual rights and obligations of the Seller and the customer arising in connection with the purchase of goods through the Seller's online shop.
1.2. These Terms and Conditions apply to purchases made by consumers, i.e. natural persons who do not act within the scope of their business activities.
1.3. By submitting an order, the customer confirms that they have familiarised themselves with these Terms and Conditions and agree to them.
1.4. The Seller is entitled to amend or supplement these Terms and Conditions. Rights and obligations arising under the previous version shall remain unaffected.
2. USER ACCOUNT
2.1. If the online shop allows the creation of a user account, the customer may order goods through their account.
2.2. The customer is obliged to provide correct and truthful information and to update it in the event of any changes.
2.3. The customer is obliged to protect the login details for their user account and not to disclose them to third parties.
2.4. The Seller shall not be liable for misuse of the user account caused by a breach of the customer's obligations.
3. CONCLUSION OF THE PURCHASE CONTRACT
3.1. The offer of goods presented on the Seller's website is for information purposes only and the Seller is not obliged to conclude a purchase contract for every item offered.
3.2. The website contains information about the goods offered, including prices. Prices are stated inclusive of all statutory charges and VAT.
3.3. An order is created by completing and submitting the order form through the online shop.
3.4. Before submitting the order, the customer has the opportunity to check and correct the information entered.
3.5. The purchase contract is concluded upon confirmation of the order by the Seller sent to the customer's e-mail address.
3.6. The Seller reserves the right to refuse an order, in particular in the event of exhausted stock or an obvious error in the price.
4. PRICE OF GOODS AND PAYMENT TERMS
4.1. The customer may pay for the goods using the payment methods specified during the ordering process.
4.2. In addition to the price of the goods, the customer shall also pay any applicable delivery costs.
4.3. The Seller shall issue the customer with a tax document electronically or together with the shipment.
4.4. Ownership of the goods shall pass to the customer upon full payment of the purchase price.
5. DISCOUNT CODES AND GIFT VOUCHERS
5.1. If the Seller provides the customer with a discount code or gift voucher, it may only be used in accordance with the rules stated on the website.
5.2. Discount codes cannot be combined unless otherwise specified by the Seller.
5.3. Gift vouchers cannot be exchanged for cash.
6. WITHDRAWAL FROM THE PURCHASE CONTRACT
6.1. The customer has the right to withdraw from the purchase contract without giving any reason within 14 days of receiving the goods, unless otherwise provided by law.
6.2. Withdrawal from the purchase contract must be sent to the Seller electronically at: yage@yageorganics.com
The customer may use the model withdrawal form, which forms an annex to these Terms and Conditions.
6.3. After notifying the Seller of the withdrawal, the customer is obliged to send the returned goods without undue delay, no later than 14 days after withdrawal from the purchase contract, to the address specified by the Seller in the confirmation of receipt of the withdrawal sent by e-mail.
6.4. The goods must be sent properly packaged. Shipments sent cash on delivery will not be accepted by the Seller.
6.5. The customer shall bear the costs associated with returning the goods.
6.6. The Seller shall refund the funds received from the customer no later than 14 days after withdrawal from the contract, but not before receiving the returned goods or proof that they have been dispatched.
6.7. The customer may not withdraw from the contract in respect of goods:
- manufactured according to the customer's requirements,
- which, after delivery, have been removed from sealed hygienic packaging and cannot be returned for reasons of health protection or hygiene,
- which have been consumed or whose packaging has been damaged.
This provision applies in particular to opened cosmetic products and food supplements.
7. DELIVERY OF GOODS
7.1. The customer shall select the delivery method during the ordering process.
7.2. The Seller will generally dispatch the order within 3 business days of confirmation of the order.
7.3. Upon receipt of the shipment, the customer is obliged to check the condition of the packaging.
7.4. If the customer fails to accept the shipment for reasons attributable to the customer, they may be required to pay the costs associated with repeated delivery.
8. COMPLAINTS AND LIABILITY FOR DEFECTS
8.1. The Seller is responsible for ensuring that the goods are free from defects upon receipt and comply with the purchase contract.
8.2. The customer's rights arising from defective performance are governed by the Civil Code and the Consumer Protection Act.

8.4. The Seller shall process the complaint within the statutory period.
9. INFORMATION ABOUT YAGE AND MEDDIES PRODUCTS
9.1. YAGE Organics and MEDDIES products are intended as part of a healthy lifestyle.
9.2. Food supplements are not medicinal products and do not replace a varied diet, a healthy lifestyle or medical care.
9.3. The information provided on the website does not constitute a medical diagnosis or treatment recommendation.
10. PERSONAL DATA PROTECTION
10.1. The Seller processes customers' personal data in accordance with the GDPR and applicable legal regulations.
10.2. Detailed information on the processing of personal data is provided in the Privacy Policy document.
11. COMMERCIAL COMMUNICATIONS AND COOKIES
11.1. The Seller sends commercial communications only in accordance with applicable legal regulations.
11.2. The customer may unsubscribe from commercial communications at any time.
11.3. Information about the use of cookies is provided in the Privacy Policy and cookie settings on the website.
12. FINAL PROVISIONS
12.1. Legal relations between the Seller and the customer are governed by the laws of the Czech Republic.
12.2. The Czech Trade Inspection Authority is responsible for out-of-court settlement of consumer disputes.
